Please read these Terms of Service ("Terms") carefully before using the BrainBlitzer mobile application (the "App") operated by KangaBlue ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using BrainBlitzer, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the App on behalf of a minor, you accept these Terms on their behalf.

2. Description of Service

BrainBlitzer is a free, fully offline trivia quiz game for mobile devices. The App provides multiple-choice trivia questions across five categories, timed quiz rounds with scoring, achievement tracking, and a local leaderboard with performance statistics. The App operates entirely offline and does not require an internet connection, user account, or login.

3. Licence Grant

We grant you a limited, non-exclusive, non-transferable, revocable licence to download, install, and use the App on a compatible device that you own or control, solely for your personal, non-commercial entertainment purposes, subject to these Terms.

4. Restrictions

You agree not to:

  • Copy, modify, distribute, sell, or lease any part of the App.
  • Reverse-engineer, decompile, or disassemble the App, except where permitted by applicable law.
  • Remove, alter, or obscure any proprietary notices in the App.
  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations.

5. Intellectual Property

All content in the App, including but not limited to text, graphics, sounds, quiz questions, and software code, is owned by or licensed to KangaBlue and is protected by copyright, trademark, and other intellectual property laws. The trivia questions included in the App are provided for entertainment purposes only. While we strive for accuracy, we make no guarantees regarding the correctness of quiz content.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KANGABLUE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

8. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms. You may terminate your use of the App at any time by uninstalling it from your device.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

10. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be indicated by updating the "Last Updated" date. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
